By downloading, installing, or using the Bug Identifier mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.
DESCRIPTION OF SERVICE
Bug Identifier is a mobile application that uses artificial intelligence to identify insects, bugs, and arthropods from photographs. The App provides:
- Photo capture and analysis using AI technology
- Bug identification with scientific information
- Local storage of analysis results and images
- Chat functionality for questions about identified bugs
- Collection and history tracking features
- Premium subscription features
USER RESPONSIBILITIES
1. Accurate Information
- You are responsible for providing clear, focused photographs for analysis
- You understand that AI analysis may not always be 100% accurate
- You should not rely solely on the App for critical decisions regarding dangerous insects
2. Appropriate Use
- Use the App only for its intended purpose of bug identification
- Do not attempt to circumvent premium features or usage limitations
- Do not use the App for any illegal or harmful activities
- Respect intellectual property rights of all content
3. Safety Disclaimer
- The App provides educational information only
- Do not handle potentially dangerous insects based solely on App identification
- Consult professional pest control or medical professionals when needed
- We are not responsible for any harm resulting from insect encounters
SUBSCRIPTION AND PAYMENTS
1. Premium Features
- Some features require a premium subscription
- Subscription terms and pricing are displayed in the App
- Payments are processed through your device's app store
- Subscriptions automatically renew unless cancelled
2. Free Tier Limitations
- Free users have limited daily usage (e.g., 1 chat message per day)
- Premium users have unlimited access to all features
- Usage limits reset daily at midnight UTC
3. Refunds
- Refund requests are handled according to your app store's policies
- We do not directly process refunds
- Contact your app store's customer service for refund requests
INTELLECTUAL PROPERTY
1. App Content
- All App content, design, and functionality are owned by us or our licensors
- You may not copy, modify, or distribute any part of the App
- Bug identification results and educational content are for personal use only
2. User Content
- You retain ownership of photos you upload to the App
- By using the App, you grant us permission to process your photos for identification
- We do not claim ownership of your personal photos or analysis results
3. AI-Generated Content
- Bug identification results are generated by artificial intelligence
- This content is provided for educational purposes only
- We do not guarantee the accuracy of AI-generated identifications
DATA AND PRIVACY
1. Data Collection
- We collect and process data as described in our Privacy Policy
- Your photos are sent to third-party AI services for analysis
- Usage analytics help us improve the App
2. Local Storage
- Most of your data is stored locally on your device
- You can delete local data by uninstalling the App
- We do not have access to your locally stored information
3. Third-Party Services
- The App uses Google Gemini AI for bug identification
- Analytics are collected through PostHog
- These services have their own privacy policies
DISCLAIMERS AND LIMITATIONS
1. Accuracy Disclaimer
- Bug identifications are provided by AI and may contain errors
- We do not guarantee the accuracy of any identification or information
- Use the App's results as a starting point, not definitive identification
2. Educational Purpose
- All information is provided for educational purposes only
- The App is not a substitute for professional expertise
- Consult experts for critical decisions about pest control or safety
3. Limitation of Liability
- We are not liable for any damages resulting from App use
- This includes but is not limited to: misidentification, insect encounters, data loss
- Our liability is limited to the amount you paid for the App (if any)
4. No Warranties
- The App is provided "as is" without warranties of any kind
- We do not warrant that the App will be error-free or uninterrupted
- Your use of the App is at your own risk
PROHIBITED USES
You may not use the App to:
- Violate any laws or regulations
- Infringe on others' intellectual property rights
- Attempt to reverse engineer or hack the App
- Share inappropriate or harmful content
- Circumvent usage limitations or premium features
- Use the App for commercial purposes without permission
TERMINATION
1. By You
- You may stop using the App at any time
- Uninstalling the App terminates your use
- Subscription cancellations are handled through your app store
2. By Us
- We may terminate or suspend access for Terms violations
- We may discontinue the App with reasonable notice
- Termination does not affect your locally stored data
UPDATES AND CHANGES
